मजीठिया बोर्ड की सिफारिशों को लागू करने के लिए कोई रोक नहीं लगाई सुप्रीम कोर्ट ने- खड़गे

 सरकार ने सोमवार को साफ कर दिया कि मजीठिया वेतन बोर्ड की सिफारिशों को लागू करने के मामले में सुप्रीम कोर्ट ने कोई रोक नहीं लगाई है। केंद्रीय श्रम मंत्री मल्लिकार्जुन खड़गे ने लोकसभा में कहा कि पत्रकारों और गैरपत्रकारोंसे जुड़े मजीठिया वेतन बोर्ड की सिफारिशों को अधिसूचित कर दिया गया है। कई अखबार मालिकों ने इस मामले में 10 रिट याचिकाएं दायर की हैं। लेकिन शीर्ष अदालत से इसके अमल पर कोई स्थगन आदेश नहीं दिया गया है।
लोकसभा में प्रश्नकाल के दौरान मनोहर तिरकी के सवाल के जवाब में खड़गे ने कहा कि सरकार ने एबीपी प्राइवेट लिमिटेड व एएनआर बनाम भारत सरकार एवं अन्य के मामले में 2011 की रिट याचिका संख्या 246 के निष्कर्ष पर 11 नवंबर, 2011 को मजीठिया वेतन बोर्ड की सिफारिशों को अधिसूचित कर दिया था। उन्होंने कहा कि वेतन बोर्ड की सिफारिशों को लागू कराने की जिम्मेदारी राज्य सरकारों व केंद्र शासित प्रदेशों की है।
अधिसूचना की प्रति सभी राज्य सरकारों और केंद्र शासित प्रदेशों को भेजी गई है। उन्होंने बताया कि मंत्रालय ने राज्य सरकारों और संघ राज्य क्षेत्र से बार-बार अनुरोध किया है कि वेतन बोर्ड की सिफारिशों को जल्द से जल्द लागू कराया जाए और इस बारे में हुई प्रगति की निगरानी के लिए विशेष प्रकोष्ठ व त्रिपक्षीय समीक्षा समिति का गठन किया जाए। खड़गे ने कहा कि अधिसूचना पर अमल की समीक्षा के लिए केंद्रीय स्तर की एक समिति बनाई गई है। हालांकि अभी तक किसी राज्य से सिफारिशों के लागू होने के बारे में कोई सूचना नहीं मिली है। (   नई दिल्ली, 13 अगस्त (भाषा)। )

Gogoi urged to ensure Majithia Wage Board implementation

 Guwahati, Aug 2 (PTI) Media associations urged Assam Chief Minister Tarun Gogoi today to ensure implementation of the Majithia Wage Board recommendations in all news organisations and ensure security of all mediapersons. In a letter to Gogoi, representatives of eight media associations said it is ironic that journalists, who often highlight the exploitation faced by workers in other sectors, have to work in an exploitative situation themselves. They are denied economic benefits recommended by statutory wage boards constituted by the Centre and most journalists work without proper appointment letters, PF, ESI, gratuity and leave, while journalist and non-journalist media persons in Assam are even deprived of the benefits recommended by the Minimum Wages Act, 1948. The wage board beneficiaries should include full-time rural correspondents as well as journalists and non-journalists of the electronic media. "So we demand for immediate implementation of Majithia Wage Board award in all newspaper houses in Assam," said the letter signed by representatives of National Federation of Newspaper Employees, Assam Union of Working Journalists, Journalist Union of Assam, Journalists Forum Assam, Assam Press Correspondents Union, All Assam Journalist Union, Assam Tribune Employees Union and Electronic Media Forum Assam. The associations also demanded adequate compensation to families of media persons in case of any unfortunate incident while covering news and life insurance of minimum Rs 10,00,000 for each media person. The letter said working in the insurgency-affected state was becoming increasingly dangerous for journalists. They are subjected to numerous threats from insurgents, surrendered militants and even from anti-insurgent security personnel. Statistics show that Assam has lost over 20 dedicated editors/journalists in the last two decades and not a single culprit has been punished till date, it added.

Supreme Court Final Hearing on Majithia Wage Board for journalists and non-journalists on July 31 2012
Newspaper managements on Wednesday urged early hearing in the Supreme Court of the petitions challenging the Justice Majithia Wage Board report and the subsequent government notification. For, the batch of cases scheduled for hearing on Wednesday was deferred till July 31, 2012.
Senior counsel K.K. Venugopal, appearing for the Indian Newspaper Society, made a mention before a Bench of Justices Dalveer Bhandari, T.S. Thakur and Dipak Misra for early listing. He said that on October 11, an order was passed for listing the cases for final hearing on December 7 but now the matter was put up for July 31, 2012.
Justice Bhandari told counsel: “Subsequent to that order [October 11 order] Rajasthan Patrika also challenged the report. When that petition came before me, I passed an order recusing myself from that case and directed that all connected matters be listed before some other Bench. That is the reason why the petitions are not listed today [Wednesday]. You may make a mention for early hearing before the Registrar concerned, bringing to his notice the order passed on October 11.”
Meanwhile, ABP Ltd., publishers of Telegraph and other newspapers, and Bennett Coleman and Co. Ltd., publishers of The Times of India and other newspapers, filed fresh applications challenging the November 11 notification issued by the government for implementation of the Wage Board recommendations.
The petitioners maintained that the Centre had issued the notification without applying its mind. The recommendations had not considered the wages in similar industries which had been specifically placed before the Wage Board. They argued that the Centre had failed to consider the paying capacity of the newspapers, and various recommendations like variable pay had been made without issuing notice to the affected parties.
Further, the Wage Board had modified Schedule IA and IB Grouping of working journalists in newspaper establishments and functional definitions and they would have the effect of deleting certain designations/categories from a particular group. Contending that the notification was illegal, the petitioners called for abolition of wage boards for the newspaper industry as with the efflux of time, they had lost their significance. In no other industry wages were being regulated by the government under the statutory wage board.
They sought amendment to the prayers, quashing of the notification and an interim stay of its operation.
